Since freedom requires a government that is afraid of the people, government employees should fear repercussions if they fail in their duty. Any government employee should know they face dishonorable discharge in case of a breach of trust or failure through corruption or incompetence.
Should a government employee (whether elected or hired) be dishonorably discharged for incompetence, corruption, or betrayal of the public trust, they should lose all and any retirement accounts and never receive tax dollars in any form for the rest of their life. This includes a consultant receiving money from public funds through an intermediary. Any government employee who hires a consultant who has been dishonorably discharged and pays them with funds sourced from tax dollars should also face dishonorable discharge.
If a public employee failed to do the job for which they were hired, they could face charges for defrauding the public from the monies paid to them to do so and be ordered to pay the money back as restitution. Competence is mandatory, and lack of it necessitates removal.
It should be scary to enact policies, and bureaucrats should err on the side of caution rather than move forward with no regard for the Constitution.
Any politician or public official that enacts a policy ruled by the courts to be unconstitutional shall be dishonorably discharged unless appealed. If an appeal fails to overturn the prior decision, the politician or public official will be removed. The judge overseeing the decision shall implement the discharge. Any prosecutor or judge that doesn’t prosecute a violation should also be discharged.
To maintain freedom, we need politicians, judges, and prosecutors who don’t push the limits of the Constitution or outright violate it.
These changes are likely to happen at a federal level once proven on a state level. Such is the beauty of our system of dual sovereignty. If you live in a conservative state, please do your part to discuss these concepts with your legislators to get some traction on these subjects. Proof of concept will lead to the inevitable large-scale acceptance of policies that regulate the government more than government governs the people.
